Relationship FDRP/NMAS Mediator will ensure parties to the mediation process will:

  1. Discuss with the Community / Sporting club management about the need for Mediation
  2. Identify and include issues that need to be addressed
  3. We ensure those areas where the parties are not in agreement in the mediation process are excluded as legally required
  4. With an agreement to terms by both parties, the Relationship FDRP/NMAS Mediator can then prepare an agreement
  5. Make sure this is in the correct format to satisfy the community group and or court
  6. Where there are critical issues/potential areas of disagreement between parties, the Relationship FDRP/NMAS Mediator can also assist both parties in determining their outcomes in a safe, fair manner

Making your Agreement Legally Binding

It’s important to note that an unsigned agreement reached during mediation is not legally binding. If you require a legally binding contract, seeking legal advice is necessary. Each deal is tailored to the unique circumstances of the parties involved.

In the agreement, the Family Dispute Resolution Practitioner (FDRP) can assist both parties in discussing more intangible items on which they disagree. These areas may include pet visitation, social media usage, or other relevant issues. Geoff encourages both parties to consult with a legal practitioner for legal advice on moving forward or consent orders, as only legal practitioners can provide legal advice.

Relationship Mediation FDRP Mediators ensure that:

  1. Issues needing to be addressed are identified and included
  2. Areas where parties disagree during the mediation process are excluded as legally required
  3. Upon agreement to terms by both parties, an agreement can be prepared in the correct format to satisfy the WA Family Court, which can then be sent to your lawyer for filing
